Terms and Conditions

These terms govern your use of damn.chat and its AI CAPTCHA (“the site”, “we”, “us”). They take effect the moment you enter the site. By opening or using any page of it, you agree to these terms and to our Privacy Policy. If you don’t agree, please leave the site and don’t use it.

1. The service

damn.chat is a CAPTCHA that works through conversation. You chat with an AI for up to 20 messages, and it decides whether you’re a person. Other websites send visitors here; when you pass, you’re sent back to them with a one-time token they can check.

2. Acceptable use

You agree not to:

• use bots, scripts, AI agents or other automation to complete or attack the CAPTCHA, or help anyone else do so;
• overload, scan or probe the site, or try to get around its security, rate limits or verification;
• try to make the AI reveal its instructions or produce harmful content;
• send anything illegal, hateful, harassing, sexually explicit or violent, or anything that infringes someone else’s rights;
• send images of other people without their permission, or any image that sexualises or endangers a minor;
• share passwords, financial details or other sensitive personal information, whether yours or anyone else’s;
• sell, share or reuse pass tokens, or use the site to mislead any website about who you are;
• break any law, or Anthropic’s Usage Policy, which applies to everything sent to the AI.

3. AI-generated replies

Replies are written by an AI model (Anthropic’s Claude). They can be inaccurate, odd or unexpected, and they are not advice of any kind. Don’t rely on them for anything.

4. Verification results

The verdict is made automatically and can be wrong: a real person may fail. Each result is final for that conversation, but you can start a new one, subject to rate limits. We don’t promise any particular result, and each website that uses the CAPTCHA decides for itself what to do with it.

5. What you send

You keep ownership of your messages and images. You give us permission to process, store and transmit them, including to Anthropic and in the occasional review email to the operator, only as needed to run, protect and improve the service, as described in the Privacy Policy. You are responsible for having the right to share anything you send.

6. Other websites

The sites that send you here, and the sites you’re returned to, are run by other people. Their own terms and privacy policies apply, and we aren’t responsible for them.

7. Our site

The site’s name, design and code belong to its operator. Don’t copy, scrape, resell or frame the site without permission. Sending visitors to the CAPTCHA through its normal link and checking their token is allowed.

8. Changes and access

We may change, pause, limit or stop the site at any time, with or without notice. We may block anyone who breaks these terms.

9. No warranty

The site is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, and with no promise that it will be uninterrupted, secure or error-free, or that it will stop every bot.

10. Limitation of liability

To the fullest extent the law allows, the operator is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, access or profits, arising from your use of the site or your inability to use it, including a failed verification. Our total liability for any claim about the site will not exceed US$10. Some places don’t allow these limits; where that’s the case, they apply only as far as the law permits.

11. Responsibility for misuse

If you break these terms and that causes a claim or loss for the operator, you agree to cover the reasonable costs of it, as far as the law allows.

12. Changes to these terms

We may update these terms. When we do, we’ll change the date at the top of this page. Using the site after a change means you accept the updated terms.

13. General

If any part of these terms can’t be enforced, the rest still applies. Not enforcing a term straight away doesn’t mean we give up the right to enforce it later. These terms and the Privacy Policy are the whole agreement between you and us about the site.
